This brown bag will address the legal and practical issues attorneys face when domestic violence is part of your client's experience. The types of expedited relief available under the DVPA and the potent impact of Family Code 3044 may make the DVPA a tempting tool to kickstart your custody case or moveout. But the reality is the DVPA is a shield, not a sword, and recognizing when your client may benefit from this remedy can be a nuanced issue. 

Threshold issues include (1) understanding what is abuse including the range of appellate cases that define non-physical conduct; (2) appropriate screening for DV; (3) considering the safety planning implications for clients attempting to leave and (4) advising clients on options for safe visitation. The session will also discuss issues of attorney professional responsibility such as options counseling, cultural competency and awareness of the impact of trauma on victims and children, as well as crossover matters in Criminal Court. DV is not a 'one size fits all' phenomenon and Family Law clients should be informed about services available for themselves, their children and their partners, including those interventions that can remediate abuse and help families heal. Finally, litigating DVPA matters can be extremely difficult. What types of constructive advocacy can assist clients and potentially avoid escalating a damaging dynamic?
