Conducting Effective eDiscovery Investigations: What Your Expert Can Do and What the Judge Wants to Know

Attorneys have an ethical duty to conduct a reasonable investigation of their cases. In our world today of smartphones and databases, that requires the assistance of an expert to properly investigate data from your client and opposing side.

“Conducting Effective eDiscovery Investigations” will explore the following:

  • A computer forensic expert explaining the technical aspects in launching an investigation, preserving data and executing defensible searches;
  • Understand the different stages of search, from collecting ESI to responding to discovery; 
  • The judicial perspective on what Federal and State judges expect attorneys to know about the technical issues in a case;
  • What should go into an expert’s affidavit explaining search adequacy, undue burden; or whether ESI is in a reasonably useable form;
  • Best practices in working with your client and expert to successful prove the eDiscovery issues within your case.
  • An overview of the Interim California eDiscovery Ethics Opinion and ways to meet your duty of competency.
